रेलवे परिसरों की स्वच्छता प्रभावित करने वाली गतिविधियों के लिए संशोधित दंड प्रावधान

भारत सरकार द्वारा राजपत्र अधिसूचना संख्या GSR 758(E), दिनांक 25.08.2026 के माध्यम से भारतीय रेल (रेलवे परिसरों में स्वच्छता को प्रभावित करने वाली गतिविधियों के लिए दंड) नियम, 2012 में संशोधन किया गया है।
यह संशोधन जन विश्वास (प्रावधानों में संशोधन) अधिनियम, 2026 के तहत अधिसूचित किया गया है तथा रेलवे परिसरों की स्वच्छता को प्रभावित करने वाली गतिविधियों के मामलों में संशोधित प्रक्रिया एवं दंड का प्रावधान किया गया है।
संशोधित प्रावधान के अनुसार, भारतीय रेल (रेलवे परिसरों में स्वच्छता को प्रभावित करने वाली गतिविधियों के लिए दंड) नियम, 2012 के नियम 4 को प्रतिस्थापित किया गया है। पूर्व प्रावधान के तहत अधिकतम ₹500 तक के जुर्माने का प्रावधान था, जिसे संशोधित किया गया है।
नियम 4 के अंतर्गत रेलवे परिसरों में स्वच्छता एवं स्वच्छता मानकों को प्रभावित करने वाली निम्नलिखित गतिविधियां प्रतिबंधित हैं:
(क) कोई व्यक्ति, किसी प्राधिकृत स्थान के सिवाय किसी भरे हुए या खाली रेल परिसर या डिब्बे में कूड़ा-कचरा नहीं फैकेगा या निक्षिप्त नहीं करेगा;
(ख) रेल परिसरों में पाक क्रिया, नहाना, थूकना, मूत्रत्याग, मलत्याग, जानवरों या पक्षियों को चारा देना, वाहनों की मरम्मत या धुलाई करना, बर्तन या कपड़े या कोई अन्य उपकरण धोना या किसी प्रकार का भंडारण सिवाय ऐसी सुविधाओं या शौचालयों में जो उपयुक्त किसी प्रयोजन के लिए विनिर्दिष्ट रूप से उपलब्ध कराई गई है, नहीं करेगा;
(ग) रेल या रेल परिसर के किसी कम्पार्टमेंट या सवारी डिब्बे में, किसी विधिपूर्ण प्राधिकार के बिना, कोई पोस्टर चिपकाना या लगाना या कुछ भी या विषयवस्तु लिखना या अंकित करना, अभिकार्य नहीं करेगा;
(घ) रेल संपत्ति को विरूपित करने में संलिप्त नहीं होगा;
संशोधित प्रावधान के अनुसार, उक्त नियमों के अंतर्गत दोषी पाए जाने वाले व्यक्ति पर ₹1,000 का दंड लगाया जाएगा। दंड का भुगतान नहीं किए जाने की स्थिति में संबंधित व्यक्ति को अधिकारिता वाले सक्षम न्यायालय के समक्ष प्रस्तुत किया जाएगा, जो ₹2,000 तक का जुर्माना लगा सकता है।
संशोधित प्रावधानों का उद्देश्य रेलवे परिसरों में स्वच्छता संबंधी नियमों के अनुपालन को और सुदृढ़ करना तथा रेल यात्रियों एवं आम जनता के बीच जिम्मेदार व्यवहार को बढ़ावा देना है।
Revised Penalty Provisions for Activities Affecting Cleanliness at Railway Premises

In accordance with the provisions notified by the Govt of India through Gazette Notification No. GSR 758(E) dated 25.08.2026, amendments have been made to the Indian Railways (Penalties for activities affecting cleanliness at railway premises) Rules, 2012.
The amendment has been notified pursuant to the Jan Vishwas (Amendment of Provisions) Act, 2026 and provides for a revised procedure and penalty in cases relating to activities affecting cleanliness at railway premises.
As per the amended provision, Rule 4 of the Indian Railways (Penalties for activities affecting cleanliness at railway premises) Rules, 2012 has been substituted. The earlier provision prescribing punishment with a fine not exceeding ₹500 has been revised.
The Rule 4 of the Indian Railways (Penalties for activities affecting cleanliness at railway premises) Rules, 2012 Prohibits the following activities affecting cleanliness and hygiene in the railway premises.-
No person shall,– (a) throw or deposit litter in any occupied or unoccupied railway premises or the carriage except in authorized places;
(b) cook, bathe, spit, urinate, defecate, feed animal or birds, repair or wash vehicles, washing utensils or clothes or any other objects or keep any type of storage in any railway premises except in such facilities or conveniences specifically provided for any of these purposes;
(c) paste or put up any poster or write or draw anything or matter in any compartment or carriage of the railway or any premises thereof, without any lawful authority
(d) indulge in defacing railway property.
The amended provision provides that a person found liable for an offence under the said Rules shall be liable to a penalty of ₹1,000. In the event of non-payment of the penalty, the person shall be produced before a competent court having jurisdiction, which may impose a fine up to ₹2,000.
The revised provisions are aimed at strengthening compliance with cleanliness requirements at railway premises and promoting responsible behaviour among railway users. Passengers and members of the public are requested to maintain cleanliness at stations and other railway premises and extend their cooperation towards keeping railway premises clean and hygienic.
